The difference between a licensed online casino and an offshore casino is not simply where the company is located. The central question is whether the casino is authorized to offer gambling services in the Canadian province where the player is located.

People researching brands through resources such as Miki Casino should not assume that a professional website, foreign gambling licence or Canadian themed domain means an operator is approved in Canada. The operator should be checked against the official records for the relevant province before any money or personal information is provided.

How Online Gambling Is Regulated in Canada

Canada does not have one national licensing system for commercial online casinos. Gambling offences are established under federal law, while lawful gambling is generally conducted and managed by provincial governments.

Section 207 of the Criminal Code permits a provincial government to conduct and manage a lottery scheme within that province in accordance with provincial law. The term lottery scheme is broad and can include many forms of casino gaming and betting.

This structure means that legality depends heavily on location. A casino that is authorized to accept players in Ontario is not automatically authorized to operate in Alberta, British Columbia, Quebec or another province.

Most provinces offer online gambling through a provincial lottery corporation or another government controlled platform. Ontario uses a different model that also allows approved private operators to participate in its regulated internet gambling market.

What Is a Licensed Online Casino?

In everyday language, a licensed casino is one that has received permission from a recognised gambling authority. In Canada, however, it is important to ask which authority issued the licence and where that authorization applies.

A casino licensed in another country may be licensed somewhere, but that does not make it part of a Canadian provincial regulatory system.

In Ontario, private internet gambling operators must be registered with the Alcohol and Gaming Commission of Ontario and must enter into an operating agreement with iGaming Ontario before they can legally participate in the provincial market. The AGCO regulates operators and establishes standards intended to protect players and support game integrity, as explained in its online gambling guidance.

An Ontario registration therefore has a specific legal meaning. It indicates that the operator has entered the provincial framework and is subject to enforceable Ontario requirements.

What Is an Offshore Casino?

An offshore casino is generally an online gambling business based outside Canada. It may hold a licence from another country or territory and may accept registrations from people in several international markets.

The word offshore does not necessarily mean that a casino has no licence at all. Some offshore operators are regulated by foreign authorities. The legal issue is that a foreign licence does not itself provide authorization to operate within a Canadian province.

An offshore licence may establish rules between the operator and its foreign regulator, but Canadian provincial authorities may not supervise the casino or provide the same remedies that apply to locally regulated operators.

Players should therefore distinguish between a casino that is licensed somewhere and one that is authorized where they live.

Ontario Has Its Own Regulated Market

Ontario introduced a regulated market for private internet gambling operators in April 2022. This model exists alongside the province’s government operated gaming services.

To participate, a private operator must satisfy the provincial registration process and operate under an agreement with iGaming Ontario. Operators must comply with rules relating to game integrity, player identification, responsible gambling, advertising, privacy, security and the prevention of financial crime.

The AGCO maintains access to an official directory of registered internet gaming operators. Checking this directory is more reliable than relying on a logo or licensing statement displayed by the casino itself.

If a casino accepts Ontario players but does not appear through the official regulated market, it should not be described as an Ontario licensed casino merely because it holds a foreign licence.

Are Offshore Casinos Illegal for Canadian Players?

This question does not always have a simple national answer. Canadian gambling law focuses significantly on the unlawful conduct, management and operation of gambling activities. Player circumstances can depend on the type of gambling, the province, the location of the operator and the way the service is offered.

The existence of an offshore website that accepts Canadian registrations does not prove that the operator is authorized under Canadian law. It also does not mean that the player receives the protections available within a provincial system.

A person seeking advice about their own legal exposure, a disputed payment or a particular operator should speak with a qualified lawyer in their province. General information about online gambling should not be treated as advice for a specific case.

Why Provincial Authorization Matters

A regulated provincial market provides a local authority that can establish rules and take enforcement action. Approved operators can be required to verify player identity and age, protect account information, maintain game integrity and provide responsible gambling controls.

These rules may also address the handling of player funds, complaints and account restrictions. If a registered operator fails to comply, the provincial regulator can investigate and impose regulatory consequences.

An offshore regulator may provide some protection, but its rules and complaint procedures can be very different. A Canadian player may need to pursue a dispute in another country, and the relevant authority may have limited power to assist someone located in Canada.

This becomes especially important when a casino delays a withdrawal, closes an account, requests additional verification or applies an unexpected bonus condition.

Foreign Licensing Logos Can Be Misleading

A gambling website may display a licensing number, security badge or responsible gambling logo. These symbols should be verified independently.

Players should visit the regulator’s official website and search for the operator’s legal name, approved domain and current licence status. A licence issued to one company or website should not be assumed to cover another site with a similar name.

Impersonation websites may copy a casino’s branding, legal text or licensing graphics to appear legitimate. Players should confirm the exact domain rather than relying only on the brand name shown at the top of the page.

A casino that claims to be regulated in Ontario should be connected to an operator listed through the official Ontario system. A foreign licence alone is not a substitute.

Consumer Protection Can Be Harder Offshore

When a player uses an offshore casino, Canadian consumer protection and regulatory options may be limited. The casino may operate under foreign contract terms, use a foreign dispute process and store personal information in another jurisdiction.

Recovering disputed funds can be difficult if the operator refuses to cooperate. A player may also have fewer practical options if the casino changes its terms, blocks access or fails to honour a withdrawal.

The fact that a casino accepts Canadian dollars or offers Canadian payment methods does not establish Canadian authorization. Neither does the use of provincial flags, local sports imagery or references to Canadian players.

How to Check a Casino Before Registering

Players should identify the company that operates the website and the jurisdiction in which it claims to be licensed. They should then verify the licence through the official regulator rather than following an unverified badge or copied link.

Ontario residents can check whether the operator and gaming site are part of the regulated provincial market. Residents of other provinces should consult the official gambling authority or provincial lottery corporation for their location.

The website’s terms should also explain who holds player funds, which law governs disputes and where complaints can be submitted. If this information is missing or difficult to verify, the player should be cautious.

The Legal Difference Comes Down to Authorization

A licensed casino is not necessarily licensed for Canada merely because it holds a gambling licence abroad. The most important question is whether the operator is legally authorized within the player’s province.

In Ontario, this generally means registration with the AGCO and an operating agreement with iGaming Ontario. In other provinces, lawful online casino services are generally provided through the applicable provincial system.

Offshore casinos may operate under foreign licences, but they sit outside the local provincial framework unless they have obtained the required Canadian provincial authorization. That difference affects regulatory oversight, complaint options and the practical protection available to players.

Before creating an account, Canadian players should verify the exact operator, website address and provincial authorization. A few minutes of checking can help prevent confusion between a locally regulated casino, a foreign gambling business and a website that may be misusing another brand’s identity.
